By utilizing the services of NestWell Nanny Agency, you agree to the following Terms & Conditions.
1. Services Provided
NestWell Nanny Agency acts as a professional facilitator for:
Nanny matching, placement, and childcare consulting.
Background check coordination and contract setup guidance.
Nanny share, newborn care, and date night facilitation.
Ongoing placement support and HR-style mediation.
2. Pricing, Payment & Financial Flexibility
Methods: PayPal (Required), Venmo, and Cash App (on a case-by-case basis).
Budget-Friendly Installments: Weekly and monthly installment arrangements are available for all plans. Customized structures typically range from $35 to $450 per month.
Non-Refundable Entry Costs: Intake form processing and onboarding fees are strictly non-refundable as they cover immediate administrative costs.
3. Comprehensive Refund & Cancellation Policy
I. Strictly Non-Refundable Items:
Intake Form Fees: Non-refundable once the profile is initiated.
Background Screening Fees: These are final once a link is issued or processing begins via Checkr.
II. Ongoing Service Fee Refund Schedule:
Within 24 Hours of Purchase: 100% Refund of the service fee.
Within 7 Days of Purchase: 70% Refund of the service fee.
After 14 Days: Refunds are generally not issued as active vetting is underway.
After 30 Days: Strictly No Refunds. * Replacements: At the agency’s sole discretion, one (1) complimentary replacement search may be provided depending on specific package circumstances.
4. Background & Reference Checks (The Safety Standard)
The Standard: All candidates must have a valid check from the past 12 months. Basic Checks are included at no extra cost to the family.
Upgrades: Families only pay the price difference for Standard (+$30) or Comprehensive (+$60) packages.
Expiration: Links expire after 7 days. Expired links require a new purchase at the full rate.
5. Emergency Care & Specialized Search Fees
To initiate an immediate or specialized search, the following non-refundable fees apply:
Emergency Sitter Search Fee: $75
Newborn Care Specialist / Baby Nurse Search Fee: $95
Ultra-Urgent Placement: An additional $25 fee applies for requests requiring a placement in 2 hours or less.
6. Specialized Ongoing Support & Payroll Guidance
Monthly Check-ins: Scheduled calls to discuss nanny performance and household harmony.
Compliance Maintenance: Annual background re-vetting and vaccination tracking (Flu, COVID-19, Tdap).
Payroll Support: Ranging from $35/mo (Admin) to $45/mo (Full Management) for tax and legal compliance.
7. Late Payment & Service Suspension Policy
48-Hour Grace Period: Payment is due as scheduled.
Standard (Non-HPF): $25 late fee at Day 3. Service hold at Day 5. $35 fee and account ban at 30 days.
High-Profile (HPF): $150 late fee at 48 hours. $300 fee at 10 days. $500 Reconnection Fee at 30 days.
8. Confidentiality, NDA & Liability
Confidentiality: All information regarding families and nannies is strictly confidential.
High-Profile NDAs: HPF placements require a legally binding NDA to be executed prior to interviews.
Social Media: Any breach of digital privacy (geotagging/photos of children) results in an immediate and permanent ban.
Indemnification: Families agree to hold NestWell Nanny Agency harmless from any claims or damages arising from the employment of a nanny.
9. Governing Law
These Terms are governed by the laws of New York State. Disputes must first be addressed through mediation before any legal action is pursued.

NestWell Nanny Agency: Master Terms & Conditions

These Terms & Conditions apply to all nannies and families utilizing NestWell Nanny Agency. By using our services, you agree to the following:
1. Agency Scope & Services
NestWell connects professional caregivers with families in New York and California.
Standard Support: We connect nannies with families at no cost for standard placement.
Optional Add-Ons (Fee-Based): Background Checks (Basic $27, Standard $57, Comprehensive $87), CPR/First-Aid, Resume Setup, Specialty Certifications, Contract Review, Workers’ Rights Coaching, and Customized Job Matching.
2. Background Check & Verification Protocol
15-Day Rule: Every nanny must have a valid check on file within 15 days of application.
Accepted Options: Submit your own (within 12 months), family-conducted checks, or purchase through NestWell.
Finalization: A completed background check is required before any placement is finalized.
The "Elite Talent" Fast-Track: For families seeking high-potential candidates, we may offer the option to sponsor expedited screening costs to move a profile off "pending" status immediately.
3. Payment & Late Fee Policies
A. Nanny Add-On Services:
Grace Period: 24 hours.
Late Fees: $15 after 24 hours. An additional $15 is added at 30 days.
Hold Policy: At 5 days late, a 72-hour hold is placed on your profile. At 2 weeks, a temporary ban from resources is enforced. At 30 days, you are banned until cleared.
B. High-Profile Family (HPF) Accounts:
Grace Period: 48 hours.
Initial Late Fee: $150 automatically applied after 48 hours.
10-Day Late Fee: An additional $300 fee is applied; support services are restricted.
30-Day Disconnection: Account is disconnected. A $500 Reconnection Fee is required to resume oversight.
Staff Notification: NestWell reserves the right to contact the personnel or staff working in your home to notify them that agency advocacy is on hold due to account delinquency.
4. Digital Footprint & Social Media Audits
Search Authorization: NestWell conducts audits of public social media (Instagram, TikTok, etc.) and professional sites (Care.com, Sittercity).
Integrity: Any discrepancies between your application and other caregiving platforms, or content compromising family privacy, will result in an immediate and permanent ban.
Accuracy: False, misleading, or omitted information results in immediate removal from the roster.
5. NDA & Confidentiality for All Placements
I. Mandatory High-Profile NDA: While we maintain standard confidentiality for all, High-Profile Families (HPF) require a secondary, legally binding Non-Disclosure Agreement (NDA). This must be executed before any in-home interview or trial. II. Scope of Protection: This prohibits disclosure of family names, guests, addresses, estate layouts, business affairs, or travel itineraries. III. Geotagging & Media: Caregivers are strictly forbidden from "geotagging" locations or mentioning employer names on social media. Photos/videos inside the home are strictly prohibited. IV. Penalties: Breach of privacy results in immediate termination, a permanent ban from NestWell, and potential legal action from the family.
6. Refund & Cancellation Policy
24-Hour Rule: 100% refund if canceled within 24 hours of purchase.
Non-Refundable: Background checks are strictly non-refundable once processed.
Service Changes: NestWell may modify or discontinue services. Prorated refunds for discontinued paid add-ons may be requested.
7. Payment Notes
Primary payment method: PayPal Invoice.
Venmo and Cash App accepted in specific cases.
Pricing is subject to change with prior notice.
